Allowing a still image to be displayed on your monitor for an extended period of time can cause an image to burn in and remain on your screen permanently. Examples of still images include:

  • Channel logos;
  • On-screen information; and
  • the Opal Program Guide.

Some televisions are more prone to burn-in than others. We recommend that you consult your television manufacturer’s manual for proper operating instructions.

Pay Per View Programs

The Opal Service is based on a Pay Per View system whereby you can purchase Pay Per View Programs for a fee. Pay Per View programs may require a broadband internet connection. These downloads may be metered by your Internet Service Provider.

Opal Broadcasting Terms of Use

Please read these Terms carefully so that you understand them. If you are reading on a TV screen and would like to read on your computer or print a copy, please visit https://opalbroadcastingnetwork.tv and follow the links for an online copy of the Terms. We may change these Terms at any time in accordance with clause 7, and you can always find the latest version by visiting Our Website. If we consider a change to these terms will make you worse off, we will give you notice of the change and you may choose to cancel your Account as set out below. Capitalised words (such as Pay Per View Program) have special meanings, which are explained in the Dictionary at the end of these Terms.

[lead]1. Who May Use the Opal Service[/lead]

1.1 You must be at least 13 years old and have permission from your parents or guardians to use the Opal Service, if you are under the age of 18.

Parents and Guardians

1.2 By granting your child permission to use the Opal Service:

a. You agree to the terms of this Agreement on behalf of your child. You are responsible for monitoring and supervising your child’s use of the Opal Service. If your child is using the Opal Service and is either under 13 or does not have your permission, please contact us immediately so that we can disable his or her access.

b. You acknowledge that using the Opal service content may be accessed classified M, MA15+ and R18+. M and MA 15+ content is considered unsuitable for persons under 15 years of age and is a legally restricted category. R 18+ content is legally restricted to adults. Some material classified R 18+ may be offensive to sections of the adult community.

[lead]2. The Service[/lead]

What is the Opal Broadcasting Service?

2.1 Opal will provide you with the Pay Per View Package. If you so choose, your Service may also include any Additional Packages that Opal makes available from time to time. If charges apply for these additional services, you authorise us to charge any payment for these services to your Account in accordance with this Agreement.

When does your agreement begin?

2.2 This Agreement starts when you begin to use the Opal Service online.

Important limitations to your use

2.3 You must make sure you do not use the Service in a way that would result in you, us, or any other person affected by your actions, breaching any law (including by infringing any person’s copyright or breaching these Terms).

2.4 You may only view the Program after the online broadcast date in accordance with Content Terms applicable to the particular Program. You must not use the Program in any manner inconsistent with the rights or restrictions set out in the Content Terms. In particular, unless the Content Terms allow you to do so, you must not do any of the following:

a. Display or make the Program available to the public or in a public space;

b. Re-supply or re-transmit the Program to another person;

c. Transfer the Program from your Computer or Electronic Device to any other device or computer (except to the extent normal operation results in transfer to a computer monitor or television screen); or

d. Remove the Computer or Authorised Electronic Device from Australia while it contains any Program.

How you can access the Opal Service

2.5 You may only access the Opal Service from your Computer or an Electronic Device.

2.6 To access the Service from an Electronic Device, it must be connected to the Internet.

2.7 To access the Service on your Computer:

a. You must be able to access Our Website; and

b. the Computer must meet the minimum requirements set out on Our Website.

2.8 You are responsible for arranging and paying for a Broadband Connection that connects your Computer or Electronic Device to the Internet, allowing it to access the Opal Service. The Broadband Connection must meet the minimum requirements specified from time to time on the FAQ page of Our Website.

2.9 You may be charged data-based download charges for using the Service Broadband Connections in addition to the charge you pay to access the Program through the Opal Service. Or your Broadband Connection may be “shaped” (or intentionally slowed down) due to the volume of Program accessed through the Opal Service. Please note that Programs typically constitute a large amount of data.

2.10 Your Internet Access plan may or may not take into account Program accessed through the Opal Service for the purpose of calculating excess data charges or shaping. Hourly plans including dial-up and satellite plans and international roaming probably will charge extra for accessing the Opal Service but others may not. You can check whether the Opal Service is unmetered on your Internet Access plan by checking the terms of your plan.

2.11 You acknowledge that:

a. The experience of playing the Program (including speed and smoothness) partly depends on your Broadband Connection, other devices and users connected to your Broadband Connection and other tasks you are using your Computer or Authorised Electronic Device for at the same time; and

b. You may not be able to immediately view a Program after purchasing the Program – it may take some time for a sufficient portion of the Program to be buffered before it can be streamed.

Unauthorised purposes

2.12 You must not use the Opal Service or the Opal Website to do any of the following:

a. Defame, abuse, harass or otherwise violate the legal rights of another person;

b. Transmit files that contain viruses, corrupted files or any similar software that may damage or adversely affect the operation of another person’s computer, Our Website or the Service;

c. Advertise or offer to sell any goods or services for any commercial purpose;

d. Transmit surveys, contests, pyramid schemes, spam, unsolicited advertising or promotional materials or chain letters;

e. Falsify or delete author attributions, legal or other proper notices, or proprietary designations or labels which specify the origin or source of any material;

f. Collect or store personal information about another person; or

g. Engage in any illegal activities.

[lead]3. Charges[/lead]

3.1 All charges will be shown before you choose to view any Program.

3.2 Any monthly charges are payable in advance. Other charges are payable at the time of viewing unless stated otherwise.

3.3 How we charge you depends on the method you have chosen. If we have informed you that your charges will be debited from your credit card, your charges will appear on your credit card bill (we only accept Mastercard and Visa). You may choose the method of billing you use, but not all billing methods will always be available from all Electronic Devices or Computers.

3.4 If you provide us with a credit card for the purpose of billing or to verify your age, it must be a valid credit card which you are authorised to use.

3.5 If you use a credit card for charges, you agree that we may:

a. Bill all charges related to the Service to that credit card;

b. Disclose details of the credit card and information about you as set out in the section “Your Privacy”, below.

Making payments

Paying us for the Opal Service

3.6 You must provide us with accurate and complete billing information including your legal name, address and telephone number. If you are on a Pay Per View Package you must pay before you can view the Program selected.  If you elect to subscribe to another kind of Package Opal may offer from time to time you must pay us every month, in advance of the next Bill Period:

a. Your Subscription Fee for the Package you have subscribed to; and

b. All other charges for the Opal Service (including any Pay Per View Program charges) that have been incurred at your home and/or on your Account during the current or a previous Bill Period, that have not yet been paid.

3.7    We will calculate the above amounts on or around your Payment Date. All Opal Services will be billed to the same account, and have the same Bill Period.

How do you pay?

3.8 There are two ways you can pay us:

a. If you are on a Pay Per View Package you must pay for each view of each Program prior to viewing by credit card or PayPal via our Website.

b. If you subscribe to a Monthly Package we can debit the amount that you owe us each month directly from a bank account, credit union account, or credit card nominated by you.

3.9 Once you have set up a direct debit on or around the Payment Date each month, we will debit your nominated account for the amount due. We will not automatically send you an invoice but you can access one through your Online Account. If you ask us to, we will send you a paper one and charge you the fee specified in the Pricing Guide.

What happens if you do not pay?

3.10 Unpaid debt can be a real problem for us.  For that reason, if (i) a credit card, or PayPal is declined or (ii) you fail to pay us the total amount due by the date specified on an invoice or (iii) your payment is unsuccessful, we will notify you by text message, email, letter or telephone that an amount is overdue. If the amount outstanding is not immediately paid then we can do one or more of the following:

a. charge you interest on the unpaid amount from the due date to the date on which we receive full payment (at an annual rate up to the official cash rate set by the Reserve Bank of Australia plus 5% – you can check the cash rate at http://www.rba.gov.au);

b. Cancel or suspend your Account (provided we comply with clause 8);

c. Terminate this Agreement;

d. Take legal action against you to recover the unpaid amount; and/or

e. Refer you to a collections agency.

What happens on reconnection?

3.11  If you pay all outstanding amounts after your Account has been suspended for non-payment, you may re-subscribe. If you are subscribing to any Package other than our Pay Per View Package, we may also require you to pay all future fees and charges before you may re-subscribe. We will provide you with the same Package that you subscribed to before the Opal Service was suspended, however you may no longer be eligible for any discounts you were receiving prior to the suspension.

Do fees and charges include GST?

3.12 The Subscription Fee and the other charges set out in the Pricing Guide include GST where applicable. If any other amounts are payable under this Agreement (being amounts not set out in the Pricing Guide) and such amounts incur GST, you will be required to pay us the relevant amount of GST. Any GST payable is displayed on your invoice and if an item is exempt for GST it will be clearly marked.

Can fees and charges change?

3.13 We can change all fees and charges in connection with the Opal Service at any time. If we make any changes to fees and charges, we will provide you with 21 days’ notice of any such change. We can also impose new fees or charges. If this occurs, you may have termination rights under clause 8.2.

Refunds

3.14 We will refund you all fees and charges you have paid if you have not been able to access the Program you have selected unless the sole reason you have not been able to access the Program is attributable to your actions or omissions.

[lead]4. Membership[/lead]

You may elect to become a member of the Opal Service.

Your account and who can use it

4.1 You must ensure your username and password are kept secure and secret. You are responsible to us for any action or omission by any person using your Account and must ensure any person using your Account complies with these terms.

4.2 Any person to whom you provide your name and surname and password will have access to your Account. You remain responsible for use made of your Account by such person.

4.3 You must provide us with a valid e-mail address and promptly tell us if you change that address. We will use e-mail to inform you of account issues. By registering you have agreed to receive promotional communications from Opal and we will also use this e-mail address to send such communications.

When does your membership begin?

4.4 Your Memebership starts when you agree to take up the Opal Service membership online.

How long is the term of your membership?

4.5 You may unsubscribe from membership at any time. If you agree to any Fixed Term when you subscribe to the Opal Service, then the term of your subscription is for that Fixed Term. When the Fixed Term ends, we will continue to provide you with the Opal Service on the terms of this Agreement until you or we end it.

Managing your Membership

4.6 How can you change your package?

You can change your Package at any time by using the Opal Website. If you upgrade during a Bill Period you will be charged the fee(s) set out in the Pricing Guide for the additional services in arrears at the end of that Bill Period and the upgrade will take effect immediately. After that, the fees will be payable in advance like all the other fees for your Package. You can downgrade at any time, but the change to your Package will not take effect until the end of the current Bill Period and you will not receive a refund of any amounts paid.

4.7 Managing your account

You can manage your Account online on the Opal Website. You must take reasonable steps not to disclose any username, passwords, passcodes (including but not limited to PINs) or account information to unauthorised persons. You must advise us of any unauthorised access or use of your Opal Service or Online Account, as you will be liable for any transaction that is initiated from your computer or device.

[lead]5. Special Offers and Trial Plans[/lead]

5.1 Clauses 3.4 and 3.5 of these Terms apply to you even while you are accessing the Service under a special offer or trial plan. This is because there may be circumstances in which you agree to a charge for a Program or other content not included in the special offer or trial plan, we may need to check your details to transition you to another plan at the end of the special offer or trial period, and because we need to verify your age even if no charge will apply.

5.2 If your Account is suspended during a special offer or trial period, that special offer or trial stops applying to you from the time of that suspension.

5.3 Additional terms and conditions may apply to a special offer or trial plan. Please check when you take up the offer or trial.

[lead]6. Your Privacy[lead]

6.1 Please read our “Protecting Your Privacy” statement at https://opalbroadcastingnetwork.tv/privacy-policy/. It sets out how we collect, use and disclose your personal information (including for the purpose of marketing to you) and your rights to access and correct that information.

6.2 In certain circumstances we may need to disclose information about you to others. We ask, and you agree, that we may subject to the Privacy Act 1988 (Cth):

a. Disclose information about you to, and obtain information from, any financial institution or card issuer to verify your details and details of the credit card;

b. Take steps to verify there is sufficient credit on your credit card to meet any charges we consider might become due in relation to the Service.

c. Disclose information about you (including information relating to conduct of your account) to:

i. Credit reporting agencies to obtain and maintain a Credit Information file about you;

ii. Credit providers or collection agents to collect overdue payments which you owe us and to notify any default by you; and

iii. Our contractors or agents who are involved in the supply of the Service; and

iv. Obtain and use information about your creditworthiness (including consumer or commercial credit reports) from credit reporting agencies, credit providers or other businesses that report on creditworthiness for the purpose of assessing any application by you or collecting overdue payments.

6.3 We ask and you agree that we may, in accordance with our “Protecting your Privacy” statement and clause 5.2, disclose Personal Information about you (including sensitive information about you) to Program content providers and licensors for the purpose of assisting them to enforce their intellectual property rights.

6.4 Our Website uses cookies. Cookies are pieces of information stored on your Computer which allows us to track your use of the Opal Website and allows us to customise information you see, improving the experience of using our Website. Most web browsers are pre-set to accept and store cookies. You may choose to turn this functionality off, or set your browser to warn you when a cookie is being stored on your Computer. For more information, use the “Help” menu in your web browser or contact the company that makes your web browser.

[lead]7. Content on the Service[/lead]

Others’ commercial products

7.1 The Opal Service may contain information about products and services offered by third parties, including product details, pricing, availability, performance and editorial commentary. We are not responsible for any reliance that you place on any of this content (including, but not limited to reviews and movie descriptions).

User generated material

7.2 We cannot guarantee the accuracy, integrity or quality of content which other users post on or in relation to the Opal Service, including in user opinion, message board or feedback areas. We have the right, but not the obligation, to: a. review such material before it is made available to other users; and b. remove any content that we, in our sole discretion, consider objectionable (on the basis of language, content, relevance, appropriateness or likely offense to others).

7.3 You agree to use any communication facility which we make available (for example, chat, forum or review services) only to send and receive messages and material properly related to that facility, legal, considerate of other users of the facility and which does not carry any risk to our reputation as a result of facilitating the communication.

7.4 You are solely responsible for all material that you upload, post, email, transmit or otherwise make available to us and other users (“Your Content”). You certify you own all intellectual property rights in Your Content or have been licensed to use it as you have (including in relation to your sub-licence to us below).

7.5 You grant to us, our agents, and contractors a worldwide, irrevocable, royalty-free, non-exclusive, sub-licensable licence to use, reproduce, communicate to the public, create derivative works of, distribute, publicly perform, publicly display, transfer, transmit, distribute and publish Your Content and subsequent versions of it for one or more of the following purposes:

a. Displaying it on our Website and other users of the Service; and
b. Storing and distributing to those seeking to download or otherwise acquire it or a copy of it; in each case without attribution to you. This licence applies to distribution and storage in any form, medium or technology now known or later developed.

[lead]8. Changing these Terms[/lead]

8.1 From time to time, we may change these Terms to reflect our changing business. Any change will be in accordance with this clause 7.

8.2 We will notify you of a change at least 30 days before it will take effect unless:

a. The change will benefit you (in which case no notice will be given); or

b. We need to make the change in order to ensure we comply with the law or a contract with another party (in which case we will give you as much notice as we can).

8.3 If we notify you of a change you may cancel the Opal Service by sending us an email to that effect within 14 days of our notice of the change. Your cancellation will take effect on the date we receive it. If you do not notify us of your cancellation, you will be taken to have agreed to the change by continuing to use the Opal Service after the date the change takes effect.

8.4 To notify you of a change we will send an email to your nominated email address and post a revised copy of these Terms on the Opal Website.

[lead]9. Suspension and Cancellation[/lead]

Cancellation by You

9.1 You may cancel your Membership Account and your obligation to comply with these Terms if all of the following apply:

a. We seriously breach these Terms (for example, if we fail to use reasonable care and skill in providing the Service to you);

b. You have notified us in writing of our serious breach; and

c. Either we have failed to remedy the breach within 14 days of us receiving your notice, or the breach is something that cannot be remedied (in which case your cancellation is effective when we receive the notice). We will not charge you any cancellation fee if you cancel because of our serious breach.

Cancellation by Opal

9.2 If you are using the Opal Service under an agreement with us that includes a minimum contract period, we may cancel your Account and our obligation to comply with these Terms before that period by giving you reasonable notice of cancellation (of at least 30 days) and we take reasonable steps to appropriately offset the effect of the cancellation on you (for example, by providing a credit or rebate). If we cancel your Account and our obligations in this way, we will not charge you any cancellation fee.

9.3 If your use of the Service is not subject to any minimum contract period, we may cancel any or all of the Service, your Account and our obligations under these Terms by giving you reasonable notice (of at least 30 days).

9.4 We may immediately cancel your Account and our obligations under these Terms if:

a. you seriously breach these Terms, including by failing to pay charges when due, by infringing the copyright or other intellectual property in any Program or the Service, or by using the Service in a way which we reasonably believe is illegal, likely to be found illegal or likely to cause damage to our reputation; and

b. We have notified you in writing of these circumstances and you have failed to remedy the situation within 14 days of our notice (or any longer period set out in the notice) or the circumstances cannot be remedied (in which case the cancellation is effective upon us giving notice). Infringement of copyright or other intellectual property in any Program or the Service is a breach of these Terms which is not capable of remedy. If we cancel your Account under this clause, we can charge you any cancellation fee that applies under an agreement between you and us.

9.5 We may also cancel your Account and our obligations under these Terms by giving you as much notice as we reasonably can if:

a. you become bankrupt or insolvent or seem likely to do so (in which case we can charge any cancellation fee that applies); or

b. We are unable to provide the Opal Service due to an event outside our reasonable control (such as an industrial strike or an act of nature).

9.6 We may suspend or restrict provision of the Opal Service to you in the notice period before we cancel your services under clauses 8.5 or 8.6(a). If you are liable for any charges in that time, you must pay them. If we later determine you did not breach these Terms, we will reimburse you charges paid in that period.

9.7 If we cancel our obligations under these Terms, you must immediately return all of our property in your possession to us.

9.8 Clauses 2 (the Service), 3 (Charges), 5 (Privacy), 6 (Content on the Service), 7 (Changing these Terms), 8 (Cancellation and Suspension), 9 (Liability) and 10 (Miscellaneous Terms) and any other term which, by its nature survives, apply even after both parties’ obligations under these Terms are otherwise cancelled or suspended.

[lead]10. Liability[/lead]

10.1 We accept liability for the Opal Service, but only to the extent set out in this clause 9.

10.2 We will use reasonable care and skill in providing the Opal Service and will provide it in accordance with these Terms. However, due to the nature of the Opal Service (including our reliance on some systems and services not owned or controlled by us) we cannot promise the Opal Service will be continuous or fault-free.

10.3 The Opal Service is supplied to you as expressly stated in these Terms and the terms implied by consumer protection laws which cannot be excluded by us. No other terms or conditions apply.

10.4 As the Opal Service is provided to you predominantly for personal, domestic or household use, we do not accept liability for any business-related losses that arise in relation to your use of the Opal Service. However, we will accept such liability if it cannot be excluded due to the operation of legislation. In those circumstances, our liability will be limited, if allowed under the legislation, to resupplying, repairing or replacing the relevant goods or services (as applicable), at our option, if it is fair and reasonable to do so.

10.5 We are also not liable to you for:

a. Any loss to the extent caused by you (for example through negligence or breach of these Terms); or

b. Any loss caused by our failure to comply with our obligations where that failure is caused by events outside our reasonable control (such as an industrial strike or act of nature).

10.6 You are liable to us if you breach these Terms or act negligently (as defined by the courts). However you are not liable for any loss we suffer to the extent that it is caused by us (for example through our negligence or breach of these Terms).

[lead]11. Miscellaneous Terms[/lead]

11.1 Neither you, nor we, waive any right under these Terms just because we do not exercise them or delay in exercising them.

11.2 Unless otherwise stated, a notice relating to these Terms must be in writing (which include email). If we need to notify you, we may send a notice by email to the address you provided or post a notice to your address. If we use email, you will be taken to have received the email once it leaves our servers unless we receive evidence to the contrary (for example, a “bounce-back”). If we use post, you will be taken to have received the notice 2 Business Days after we post it, unless we receive evidence to the contrary (being days other than Saturday, Sunday or a public holiday in New South Wales).

11.3 Your rights under these Terms belong to you alone. You may not transfer your rights or obligations in respect of the Service or these Terms without our prior consent – which we will not unreasonably withhold.

11.4 We may, from time to time, ask another party to provide some aspect of the Opal Service.

11.5 We may transfer all our rights or obligations (or both) in respect of the Service and under these Terms to any reputable, credit-worthy third party at any time. We will notify you within 30 days of any such transfer.

11.6 These Terms are governed by the law in force in New South Wales, and both you and we submit to the jurisdiction of the courts of New South Wales.

[lead]12. Dictionary of special words[/lead]

12.1 Words with special meanings in these Terms are as follows:

Account means your account with us to receive the Opal Service and refers to access to the Opal Service using your username and password.

Account Number means the number assigned to your Account.

Agreement means the agreement between you and us authorising you to receive the Opal Service which is made up of these terms and conditions as varied from time to time.

Additional Package means a programming package (other than the Pay Per View Package) set out in the Pricing Guide which you choose to include as part of your Package, for an additional charge.

Ancillary Services means any additional or extra services or features provided to you from time to time by Opal.

Australian Consumer Law means the consumer protection legislation set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth).

Bill Period means the period for which your monthly charges are applied, commencing on the anniversary of the activation date of your Opal Service and ending at midnight on the day before the next bill period, unless otherwise agreed with you.

Broadband Connection means an Internet connection which links your Computer or Electronic Device to the Internet and to the Opal Service and which meets the minimum connection speed required by us from time to time as set out on the Opal Website.

Child means any person under the age of 18 years of age and/or is considered a minor in which they live.

Computer means a personal computer (which includes desktops, laptops and notebooks) running operating systems and software required by us as notified on the Opal Website.

Contractors means contractors, agents and third parties with whom we have entered into agreements or arrangements with from time to time in order to act on our behalf in connection with: • contacting you; or • providing you with information pertaining to the Opal Service or any products and services that we or our Related Companies offer from time to time; or • performing, planning, research, product development and strategic, financial and other business purposes in relation to our products and services on our behalf.

Content Terms means the terms specific to your use of a Program accessed through the Opal Service. These Terms are specified through the Opal Service. For example, how long or how many times you can view the Program, prohibitions on downloading, redistributing, altering or deleting the content of the Program or advertising or marketing material forming part of, or associated with, the Program.

CPI means the All Groups Consumer Price Index published by the Australian Bureau of Statistics.

Credit Information means: a. identity particulars (name, address, and date of birth); b. your application for credit, including the amount applied for; c. the fact we are a current credit provider to you; d. payments which are overdue by more than 60 days and for which debt collection has commenced; e. advice that payments are no longer overdue in respect of a default which has been listed; and f. information that you have committed a serious credit infringement.

Easypay means a direct debt payment service that automates the monthly payment of the Opal Service from either your credit card or nominated bank account.

Electronic Device means any devices which we authorise from time to time to access the Service.

Entry Level Package means the minimum pay per view programming package required to be purchased by all subscribers in order to receive the Opal Service.

Fixed Term means any period for which you have signed up to receive the Opal Service as set out in clause 2.3.

Free-to-air Channels means any commercial television or national broadcasting service that you are able to access through your television, Computer or Electronic Device.

Government Agencies include: agencies or individuals appointed by a government (including the Telecommunications Industry Ombudsman, the Australian Communications and Media Authority or other law enforcement agencies) responsible for investigating and resolving disputes or complaints concerning your use of the Opal Service; and • the Telecommunication Fraud and Risk Association or any of its members.

GST means any value added, consumption, turnover or similar tax, impost or duty on goods and/or services.

Internet Access means a connection to the Internet.

Login Details means the user name and password you have selected to log in to your Online Account.

Online Account means an account on the Opal Website.

Opal Service means the Package you subscribe to, together with any other services you use, purchase or subscribe to from time to time from Opal including but not limited to the service of supplying Programs via the Internet to your Computer or Electronic Device.

Opal Website means https://opalbroadcastingnetwork.tv or such other website as Opal may advise from time to time.

Opal Program Guide means the program guide as published from time to time on the Opal Wesbsite.

Package means the programming package you choose to subscribe to from time to time, which must include the entry level Pay Per View Package together with any other Additional Packages you have chosen to subscribe to from Opal.

Pay Per View Program means a program or movie offered through Opal, for which you are charged a fee to view that program.

Payment Date means the monthly anniversary of the date we first provide the Opal Service to you, unless agreed otherwise with you and is the date when your Easypay direct debit payment is scheduled to be taken each month.

Pricing Guide means the Opal price guide, as varied from time to time set out at https://opalbroadcastingnetwork.tv/pricing-guide/

Program means the audio-visual content such as movies and TV episodes made available via the Opal Service.

System Specifications means the minimum technical specifications for your Computer or Electronic Device necessary to use the Opal Service set out on the Opal Website, as varied from time to time.

Subscription Fee means the Pay Per View or monthly fee (as specified in the Pricing Guide) that you must pay for the delivery of the Package you subscribe to, as it varies from time to time.

Suppliers means the contractors, agents and third party suppliers with whom we have entered into agreements or arrangements with from time to time in order to act on our behalf in connection with this Agreement.

Terms means this Agreement.

We, Our and Yous refers to Xabc Entertainment Pty Ltd trading as Opal Broadcasting Network (ABN 75 151 022 507) and its employees, agents, sub-agents and their respective employees.

You means the Opal customer identified as the account holder in our database. 11.2 References in these Terms to your use of the Opal Service includes use by you and by any other person using your Account.
